LESSON OF THE SNOW FLAKE

I want to share with you the lesson of a snowflake. Individually it is the lightest, most delicate, fragile thing in the world. It takes over 22,000 snowflakes to add up to one pound snow. A cubic foot of snow can weigh over 62 pounds. But 10 inches of fluffy snow floating down to cover an acre of ground weighs over a ton. 
And if you keep piling up snowflakes for something over 800,000 years, which has happened in Greenland, you get rivers of ice - 53 glaciers on the world's largest island. Winter after winter, century after century, for perhaps 15,000 years, the gentle, ethereal fresh snow compresses the older snow beneath it, until 50 feet below the surface it becomes solid ice, and 2 miles down it crushes the water molecules so their oxygen-hydrogen bonds lock together in long bands, making glacial ice sharp blue and hard enough to cut steel and crush human lives.
The fastest of Greenland's “tortoise rivers” , the Jacobshaven glacier begins 300 miles from the western coast, at a 50 mile arc of 11,000 foot high snow ridges, 42,471 square miles of compressed snow flakes, fed by 118 inches of new snowflakes in an average year. The base of this 2 mile thick ice machine is lubricated by a thin sheen of melt water against the bedrock, allowing the glacier to be squeezed like toothpaste from a tube, rushing 40 miles to the coast at 70 – 110 feet a day toward the 3 mile wide Jacobshaven Fjord.
As late as 1983 the ice did not stop when it reached the water. Marine biologist Richard Brown could write, “The tongue of ice grows into a long, floating slab, anchored only by the hinge of ice at its landward end. But the hinge becomes more and more precarious as the ice pushes farther out and the tides begin to work on it, up and down, twice a day. The cracks...soon become crevasses....at last... the deepest crevasse breaks through with a roar which echoes off the sides of the fjord like a mountain in labor. 
"The slab crashes off the face of the glacier, scattering seabirds as it goes. A surge of water, three feet high, runs ahead of it and batters its way along the walls of the fjord. The ice berg is launched.”
It is called “calving”, and the 36 mile long fjord is jammed with thousands of newly born bergs, big and small, that scrape against the edges and bottom of the inlet. With the arrival of autumn, the air atop the ice sheet “...comes rushing down the fjord in a hurricane wind....(and) the bergs begin to move...until they are drifting almost as fast as a man can walk....grinding, jostling past the little port of Jackobshaven (above)  and out into the sea at last.”
Each year western Greenland produces 25- 40,000 icebergs, averaging 5-11 million tons each. Sunlight melts the surface, while the colder sea water protects the body of the berg. The berg becomes unbalanced, top heavy and repeatedly rolls over, offering a fresh face for the sun to attack. The bottom of Baffin Bay is coated with gravel and rocks scrapped off the hidden mountains of Greenland and dropped from rolling bergs like pennies slipping through a hole in your pocket. A few of hundred of these islands of fresh water ice in a salted sea make it through the Davis Strait and into the North Atlantic, to be shepherded south by the Labrador current.
The particular berg that is the subject of our story, has battled storms and seas that would have destroyed anything made by humans. But now, on a moonless night, the berg is approaching a border. The ocean has gone calm and placid. The air, at the very center of a high pressure area, has gone still as well, the pressure so high there is no fog. Close to the water surface a faint obscuring mist has gathered, held down by warmer air sent north from the gulf of Mexico.
Approximately 380 miles south-south east of Cape Race, Newfoundland, in a meandering, swirling collision, the cold southbound Labrador water overrides the northbound warmer - up to 68 degrees Fahrenheit warmer – Caribbean air, heated by the approaching Gulf Stream current. And then, out of the still dark, flickering lights appear over the horizon, and quickly grow brighter and steadier. An object is approaching. It is dwarfed by the 2 million tons of the remaining berg, 200 feet long and looming 140 feet above the water line, meaning perhaps 1,000 feet below. 
A human witness, on board the approaching object says it resembles “the Rock of Gibraltar”. The human object was less than a thousand feet long, and sits just over 100 feet above the water. But is moving so quickly, pushing 52,000 tons of sea water aside as it plows through the water at 20 knots – 23 miles an hour -  in a most unnatural straight line, on a collision course with the berg..
Abruptly, the object begins to emit noises, first clanging and then shrieks. The tenor of its thrashing changes. At last it begins to swing away from the ice, slowly, as if distracted by a voice faintly heard. But it is not enough. The berg feels the shudder of contact. But the human forged metal is no match for the glacier ice, compacted over a thousand years by hundreds of millions of tons of compressing snowflakes. The metal bends ever so slightly. A chunk of ice snaps off the surface of the berg, and shatters on to the deck of the Royal Mail Ship Titanic.
The iceberg rocks a little from the force of the impact, spins a little, and keeps on drifting southward, changed only by a smear of red and black paint along one of its sides.”  The Titanic stops not far from the collision, and begins to make new sounds, and shed small pieces of itself. Then, within four hours, the Titanic is swallowed by the sea.
At dawn the next morning, another, even smaller object, approaches the berg. She is the R.M.S. Carpathia, soon to be joined by other similar objects. And for a few days the berg is surrounded by small human made structures. On one of these is the Russian-East Asiatic Steam Ship Birma, First Officer Alfred Nielsen takes a photograph of the iceberg (above), one of only three confirmed and mutually supportive photographs of the iceberg with a red streak across her flank, and thus blamed for the loss of the R.M.S. Titanic. Then, one by one the ships move away. And for a time the berg and the detritus of the collision float together,  southward in a warming Labrador current.
Eventually, this berg crosses the border, “...a boundary between the cold, gray world of ice and seabirds and the warm blue one of flying fish and Sargasso weed. The sea on the other side is (41 degrees Fahrenheit) warmer, in a matter yards.”. As Richard Brown would later write, “The ice berg goes no further south than...300 miles north of Bermuda, and then it is nothing.”
The particular iceberg held responsible for sinking RMS Titanic, and drowning 1,500 human souls, was unusual. Of the 25,000 to 40,000 icebergs calved by the west Greenland glaciers each year, few make it into the North Atlantic. At least 1,000 icebergs crossed through the Davis Strait in 1909 and in 1912. 
That number was not equaled again until 7 years later - 1929 -  which saw 1,300 North Atlantic icebergs. It was not 15 years later - 1945 -  that number was equaled. But 22 year after that - 1972 -  saw 1,500, and just 10 years after that, in 1982,  the glaciers of western Greenland produced 1,300.  Just 2 years later, - in 1984 - there were 2,200 sited, 1,000 again one year later, and 1,900 12 years later - in 1997. 
The very next year - 1998 -  there were 1,300 icebergs. A decade later there were another 1,000 Atlantic icebergs and over 1,200 in 2009.  The glaciers of Greenland have been calving bergs at increasing rates. The iceberg that “sank the Titanic” was an early warning of what humans were doing to the planet we depend upon for our breathable air and drinkable water.
The Jacobshaven glacier has been in full retreat since 1850. And still we have refused to listen to its warnings.  Since 2003, the Greenland ice sheet has lost 10 billion tons of ice - each and every year. The Jacobshaven glacier has lost another 15 feet of thickness every year.
And in the last decade -  since 2010 -  the ice river has retreated another 3 miles up the fjord.  Once back on land, there will be no more icebergs from the Jacobshaven glacier, only a flood of fresh water. No longer will the ocean have to wait while the icebergs to melt before their salty water is diluted. 
It is a tipping point, as if the berg was getting ready to roll over for the last time. After that, things speed up.
It will be a moment even a United States Senator, holding a February snowball in his hand, will not be able to deny.  
The lesson of the snowflake is that small things eventually add up to very big things.  But, if you wait until the big thing is visible and obvious, it is usually too late to change course, to avoid the fatal collision.

JAY GOULD, The Libertarian Dream

 

I wish modern libertarians could meet Jay Gould. Because Jay Gould was unfettered capitalism in the flesh, “the human incarnation of avarice,” as one minister described him, the Mephistopheles of Wall Street, the robber baron par excellence, “prince of the railroad schemers”, and the man within whom all the theories of the libertarians about capitalism and freedom met the reality of human nature, and got the living tar beat out of it.
He (above) was a “…short, thin man with cold black eyes, a narrow face and, in his maturity, a “full black beard”. Born into poverty, his mother was active in the Methodist Church until her death, when Jay was 10 years old. When he was seventeen, Jay apprenticed himself to a surveyor, Mr. Oliver Diston, at the salary of $10 a month. When Jay started issuing his own maps for sale, Diston sued his apprentice. Jay’s attorney, Mr T. R. Westbrook,  managed to have the lawsuit dismissed. But, as one biographer noted, from that day forward, “…there was scarcely a day during his whole life that (Jay Gould) did not have some litigation on his hands.”
His map business made Jay $5, 000, which he invested with Zadock Pratt, a Manhattan leather merchant. Smothering Mr. Pratt in adoration, the 21 year old Jay proposed to write the older man’s biography. That project drew the pair into a partnership in a new leather tannery south of Scranton, Pennsylvania.  Using  Pratt’s money, Jay built an entire company town, which he named “Gouldborough”. He wrote Pratt sycophantic letters, in one describing the organizing meeting for the new community. “Three hearty cheers were proposed for the Hon(erable) Zadock Pratt…This is certainly a memorandum worthy of note in your biography, of the gratitude and esteem which Americans hold your enterprising history.”  However Mr. Pratt, who knew a lot more about the tanning business than did the young Jay Gould, had begun to see through the fog of compliments.
Pratt (above) showed up at the plant unannounced in the summer of 1858, to go over the books.  He quickly discovered them to be a confusing mess, showing unauthorized risky investments, including in a private bank which Jay had established in Stroudsburg, Pennsylvania.  But the company did not share in the bank's profits. Those went only to Jay Gould. Pratt decided to fire his erstwhile friend and sue him to take ownership of the bank.  However, Jay had anticipated this, and had already lined up a richer and more docile partner.  In August,  when confronted by Pratt, Gould stunned the man by offering to buy him out for $60,000.  Pratt quickly accepted.  The cash for the buyout had come from Jay’s new partner, Charles Lessup.
But it wasn’t long before even the somnolent Lessup began to suspect he was being had. By the fall of 1859 Lessup was panicked by the commitments Jay had made, using his good name. But it was too late.  On 6 October, 1859, facing financial disaster, Charles Lessup shot himself.  Lessup’s daughters bitterly demanded Jay repay them for their father’s lost investment, and Jay countered with an offer of a payment of $10,000 a year for six years.  He had, of course, neglected to include any interest during the five year delay.  Unfortunately for Jay, the Lessup families’ lawyers caught the omission.  Still, in the early months of 1860, it became clear that Jay was hiding huge assets from the family.
Lawyers and 40 deputized men were dispatched to the tannery on Tuesday morning, 13 March, 1860. They flashed the legal papers, ushered the workers out and padlocked the doors. They held the place for a little over six hours, until Jay returned from New York.  Just past noon some 200 men stormed the building with axes, muskets and rifles.  Four men were shot, others were badly beaten, and according to the New York Herald, “…those who did not escape were violently flung from the windows and doors…”  As Jay Gould would later boast, “I can hire one-half of the working class to kill the other half.”  The courts would eventually throw Jay Gould out of the tannery, but by then he had shifted his operations to a place more suited to his nature; the unregulated economic free-for-all that was Wall Street.
While North and South battled over slavery, Jay Gould battled over wealth. He formed his own brokerage firm -  Smith, Gould and Martin.  Like all of Gould's  partners, Smith and Martin  were soon left behind, broken and broke.  Gould  then made the acquaintance of James “Big Jim” Fisk, who made a fortune smuggling southern cotton through the Federal armies, and selling Confederate War Bonds. And even while brave men died in their tens of thousands,  Gould and Fisk joined with Daniel Drew, director of the Erie Railroad, in their own, private war.
Their enemy was Cornelius Vanderbilt (above), who owned every railroad in the east except the Erie. Naturally, “The Commodore”, as Vanderbilt liked to be called, was seeking a monopoly, so he could charge whatever freight rates he wanted, and he began to buy stock in the Erie. Sensing blood in the water, Jay and friends printed up 100,000 new shares of Erie stock, which The Commodore promptly bought, and which the board of the Erie – Drew, Fisk and Jay Gould – immediately declared to be worthless.
Bilked out of $7 million, Vanderbilt filed legal papers to examine the Erie’s books.  Jay and friends grabbed the company records and retreated to New Jersey, where they re-incorporated.  Vanderbilt then had arrest warrants issued for all three men, but since New York law could not touch them in New Jersey, the Commodore began to assemble ships and men to invade that state,  all by himself. While the Erie Board prepared to receive the invaders, Jay managed to slide a bill through the New York State assembly making the issuing of worthless stock, perfectly legal, retroactively, of course.
This trick was managed by the simple expedient of giving William “Boss” Tweed (above), the head of political graft in New York, a seat on the Erie board.  That brought the Erie War to a temporary pause.  And if you are feeling sorry for the Commodore, remember that Cornelius himself once said, “Law, what do I care about the law? Ain't I got the power?" -  another libertarian hero.  The entire bunch were so busy cheating and stealing they barely noticed the end of the Civil War.
With the Commodore’s cash, and further fortified by looting the Erie’s assets, Jay, Fisk and Drew began their own complicated scheme to raise freight rates on the Erie Railroad. Using the profits from that scheme, in 1869 they began to buy and hoard gold, because raising the price of gold would raise the price of wheat, which would allow them to raise the freight rates they charged farmers for shipping the wheat.  As insurance the trio took on another partner, Abel R. Corbin, who happened to be President Grant’s brother-in law.  The new partner gave the appearance that “the fix” was in, and other investors jumped on the bandwagon. The price of gold skyrocketed.
When President Grant learned about the manipulations, he immediately ordered the U.S. Treasury to sell $4 million in gold. On 24 September, 1869, the sudden influx hit the market like a bomb, and gold dropped 30% in a day.  The date would henceforth be known as “Black Friday” - at least until October of 1929. Thousands of investors were wiped out, including Abel Corbin. An angry mob swarmed the Gould’s brokerage offices, smashing the furnishings and chanting “Who killed Charles Lessup?” Of course the trio of Gould, Fisk and Drew, walked away from the wreckage with an $11 million profit.
Gould's own partner Daniel Drew was to be his next victim.  In 1870 Fisk and Gould sold their shares in the Erie to their one time enemy the Commodore, for $5 million. The deal gave Vanderbilt his monopoly, but it also revealed that the Erie was bankrupt.  And it left Daniel Drew, abandoned by his partners, out $1.5 million. He would die flat broke nine years later, just one more partner and one more victim of Jay Gould.
Big Jim Fisk was saved from a similar fate when, in 1871, a competitor for a woman shot him to death in a New York Hotel. After that Jay was reduced to stealing from lesser partners, such as Major Abin A. Selover, who actually considered himself a friend of Gould’s.  It was Selover who introduced Jay to a California friend of his, James R. Keene.  After Keene and Selover had both been battered by Gould in a contest for control of the telegraph company, Western Union,  Jay and Selover happened to meet on the street one day. Jay tried to walk past, but for once in his life, Jay Gould had been caught out in the open.
Selover grabbed Jay be the collar and shouted, “I’ll teach you to tell me lies!” The six foot tall Selover then threw Jay to the ground, and then yanked him up again by one hand, dangling him above the stairwell of a below-street level barbershop. With his free arm Selover began slapping the Mephistopheles of Wall Street and shouting, “Gould, you are a damn liar!” Nobody who witnessed the event interrupted to disagree. When Selover finally let go, Gould dropped 8 feet to the stairs. A stock broker the next day quipped, “It was characteristic of Mr. Gould that he landed on his feet.”
Overnight, Abin Selover became the most popular man in New York City. Jay Gould was smart enough not to press charges, since no jury could be expected to convict anyone of assaulting Jay Gould. Henceforth, Jay never went out without a body guard. He began to describe himself as the “most hated man in New York”, but there was a touch of pride in his voice when he said it. Selover eventually went broke, as did Keene. However, when he finally died in 1892, Jay Gould was the ninth richest man in America, worth about $77 million. He died a hero only to those who never did business with him. Gould scoffed at the idea that Wall Street should be regulated. “People will deal in chance….Would you not, if you stopped it, promote gambling?”
It was and is a philosophy which fails to see an advantage to drawing a line between gambling and investing. It is the philosophy of libertarianism. It is the philosophy of unmitigated greed. It was the philosophy of Jay Gould.  And people had lots of reasons to hate him. Not a very healthy hero.

BRIBERY AS A CAREER

I have no doubt that when Stephen Puter put two $1,000 bills on the desk, Senator's John Mitchell (above) promptly picked them up. At his trial John denied he took the bribe, but nothing in his previous life even hints at the possibility that the Oregon scoundrel would have left that much cash unattended so close to his own pocket even for an instant. He was a garden variety sociopath, raised to high office by his ambition and eagerness to be bought. Noted one Oregon newspaper, “His political methods are indeed pitched on a sufficiently low scale, but not below his methods as a lawyer.” That did not make him unusual for a gilded age politician. It was the reliability of his depravity that made him a star.

Senator John H. Mitchell grew up John M. Hupple about 30 miles north of Pittsburgh, Pennsylvania. In 1855, when he was twenty, John was fired from his teaching job after impregnating his 15 year old student Sarah Hoon. Forced to marry the unfortunate girl, John switched professions, and two years later he passed the state bar exam. However, the new lawyer beat his Sarah in public so often that a patrilineal grand jury was convened. John escaped being indicted by convincing his naive now 19 year old wife into dropping the charges. Whereupon John stole $4,000 from his legal clients, abandoned Sarah and his three children and fled to California with his mistress, teacher Maria Brinker. A few years later Maria's medical expenses threatened to consume John's ill gotten grubstake. So, ala Newt Gingrich, he abandoned her as well.
Arriving in Portland, Oregon in 1860 (above) with his new mistress, Mattie Price, John switched his moniker to John Hupple Mitchell and hung out his shingle. In a matter of weeks John was named the city attorney to the 1,000 inhabitants of what the locals appropriately called, “mud city”. His skills as a lawyer could be attested by the unfortunate Marcus Neff. Mr. This ambitious illiterate had paid $2.50 an acre for his 160 acre property, occupied and worked it for 10 years. In May of 1862 Neff had paid John Mitchell $6.50 to file an affidavit reaffirming his bonafidies as to the property. .Then, in November of 1863, John Mitchell sued his own client for what he claimed were $253.14 in unpaid fees.
In court, the amoral attorney Mitchell (above) swore under oath that Neff could not be found, even tho in July of 1863 the Oregon land office successfully delivered the final homestead deed to Neff in California. In February of 1864 Neff's homestead was sold at sheriff's auction, where it was purchased by future Oregon governor and Portland mayor, Sylvester Pennoyer, aka “His Eccentricity”, AKA “Sylester Annoyer”. John got the $294. 98 paid by Sylvester, and Sylvester got the 160 acre homestead. It would take a decade and require the intervention of the U.S. Supreme Court, before poor Mr. Neff's stolen property would be returned.
As this episode demonstrated, John Mitchell was always willing to help the Oregon power structure get richer, to his own benefit of course. In particular there was his toadying with the “stagecoach king” Ben Holladay (above), who had just sold his California mail routes to Wells Fargo for $1.5 million ($24 million today). Beginning in August of 1868, and financed largely by distant German investors, Holladay then began building a railroad along the Willamette river valley, from the capital of Salem north to Portland, and then south over Grant's Pass to California. It was Holladay who, in 1864, financed John's divisive election as President of the Oregon State Senate – it took 53 days and 27 ballots.  And in 1872, Holladay supplied $15,000 in bribes to secure John's election by that same legislature as a U.S. Senator. So obvious was Mitchell's toadying for his patron, ( "Whatever is Ben Holladay's politics is my politics, and whatever Ben Holladay wants I want") that both offices were one term endeavors. But it remains a testament to John's grit and greed that when Ben Holladay went bankrupt in the “Panic” of 1873, John simply switched his loyalty to the next richest man on his horizon.
The 18 year old Friedrich Weyerhauser (above) arrived in America in 1852. He so hated working on his cousins' Pennsylvania farm that he drifted west and landed a job on the Rock Island Railroad in Illinois, which led him to a job in a saw mill, making railroad ties. He ended up owning the mill, and started buying lumber mills until the Weyerhaeuser Syndicate controlled every tree processed on the upper Mississippi River. The only thing standing between Friedrich and total domination of the lumber industry was that he did not own the land on which the trees grew. Oregon offered him a remedy to that little problem.
Out on the Great Plains, railroads could be financed by awarding them a 20 mile wide swath of government land on either side of the rails. The builders could then sell this land to homesteaders who then became the railroad's customers. That was how Holladay financed his Willamette Valley line. But in Oregon’s mostly vertical terrain, money grew on trees. The state has been selling lumber to China since 1833. By 1870 there were 173 sawmills in Oregon. And it was the combination of the well intentioned homesteader program and Weyerhaeuser's ambition which remade Oregon politics for the next hundred years.
The middle man between Oregon's past and its future was one time surveyor Stephen A. Douglas Puter.     In his book, “ Looters of the Public Domain” Stephen described a process which began on board foreign vessels tied up at Portland's docks. “I have known agents of the company to take at one time as many as twenty-five men...to the county courthouse”, he wrote, “where they would...declare their intention to become citizens...(then) they would proceed direct to the land office and make their filings, all the location papers having previously been made out. Then they would appear before Fred W. Bell, a notary public, and execute an acknowledgment of a blank deed (transferring the land to the lumber company), receive the stipulated price of $50, and return to their ships...As fast as this land came into the market, the (Weyerhaeuser) company gobbled it all up.”
All told, it cost "entrymen" like Puter about $320 for each 160 acre homestead. Then, instead of land hungry farmers, Puter sold the parcels to Weyhausser through his railroad or lumber companies for a hundred dollar profit. The Oregonian newspaper estimated that between 1870 and 1904 75% of all land transferred in Oregon was sold in this fraudulent way. The great scam only came to an end because in 1903 Stephen Puter was convicted of fraud, and after serving 18 months was pardon by President Teddy Roosevelt after agreeing to turn state's evidence. With Puter's testimony,  Federal grand juries indicted more than 100 people, and convicted 33 of them. But no where on any legal papers did the name of Friedrich Weyerhauser appear, and his corporation's titles to the land were never questioned. However, John H. Mitchell's name did show up.
When John had first arrived in Washington, D.C. back in 1874, he found the capital abuzz with stories about his abandoned Sarah, back in Pennsylvania. Since John had married Mattie Price in 1862, without divorcing Sarah, he was now a bigamist. But the Senate decided morality was a matter for the voters back in Oregon, and allowed John Mitchel to sit on the Senate Railroad Committee, which is just where Ben Holladay wanted him. After his defeat for re-election in 1879,  John tried for the state legislature, but lost. In 1885 he was campaigning for a return to the Senate when, four days before the election, "The Oregonian" published love letters John had written to Mattie's sister. What kind of a man carries on a five year sexual liaison with his wife's sister? Evidently, in Oregon, a re-elected United States Senator. An opponent called his election “a disgrace to the state and a reproach to humanity.”  But it stuck.
And yet John was easily re-elected yet again in 1890, and tirelessly maneuvered to legally steal land from Indian reservations to benefit Weyerhauser's syndicate.  In 1896 John ran yet again, but the opposition finally adopted John's own “political ethics (which) justified any means that would win the battle” The legislature's was evenly divided over John Mitchell for two years, leaving the state without a second U.S. Senator. Then, in 1901 the 65 year old Mitchell won his last campaign. And it was in Senator John Mitchel’s Washington office on Sunday, 9 March, 1902, where Stephen Puter laid down those two $1,000 bills. And John picked them up.
The newly named Chairman of the Committee on Inter-oceanic Canals, now grown old and fat, responded to his indictment with a carefully worded press release. “I defy any man to charge me successfully with any conduct that is otherwise than honorable” he wrote, adding “I am sure I cannot be connected in any way with any land frauds”. No where did John claim innocence. He merely dared others to prove his guilt. So they did.
This first trial of the century for the 20th century was held in June of 1905 in the newly expanded Court House on Pioneer Square in downtown Portland. It had to compete for the public's attention with the Lewis and Clark Centennial Exposition out on Guild's Lake. While the fair, whose federal funding Senator Mitchell had pushed, attracted over 11,000 visitors a day, the courtroom could hold less than a hundred spectators. But it was the tribunal which attracted far more newspaper coverage. Testifying against Senator Mitchell was  Stephen Puter, and John’s law partner, Judge Albert H. Tanner, and even John's personal secretary. The defense tried reminding the jury about the recent death of John's daughter, and the Senator's age – he had just turned 70. But on Monday 3 July, 1905 the jury found him guilty, anyway. It was the climax to the Oregon Land Fraud Trials, and a fitting end to Mark Twain's Gilded Age. John was sentenced to six months in jail and a $1,000 fine.
He never served an hour in jail, of course. And he never paid the fine. Not because of his political connections, this time, but because of a visit to the dentist. Five months after the verdict, on Friday December 8, 1905, John had four teeth pulled, and the strain was too much for the old thief’s heart. He died, said the press, of complications after surgery. The old Republican was replaced by a Democrat.
John H. Mitchell – ne John Mitchell Hupple – was survived by a second daughter, Marie Elisabeth, who in 1892 had married the very wealthy Alfred Gaston, the 5th duke of Rochefouald and Duke of Anville. She moved to England, But the only place in Oregon which still carries her father's name is the tiny hamlet of Mitchell, with less than 200 residents. Three time in its history the town has been destroyed by floods, and three times by fires. But the residents keep rebuilding, making it a perfect monument to a man described  as lacking either ethics or ability, but making up for that with “persistence and (a) desire for success at any price.”
